While neither side while admit it - he had a gun before  he was shot,  but not during.  It was clear that the police were ramped up,  and were  already going to shoot the unarmed  man,  because they thought they were not going to be questioned about it. The problem is that the police will say that it was not clear -  on that point,  they should not have fired.  This is a case of DWB -  he should not have been shot.
